Terms of Service

Faunary is a wildlife archive and ecological memory platform that helps you organize, explore, and rediscover your wildlife photography and field observations. By creating an account or using Faunary, you agree to these Terms. If you do not agree, please do not use the service.

1. Who we are

Faunary is operated by us (“we”, “us”). You can reach us at contact@faunary.app. Our full provider details are in our Legal Notice (Impressum).

2. Eligibility

You must be at least 16 years old, or older if your country requires it, to use Faunary. You are responsible for keeping your account secure.

3. Your content, and your originals

You keep ownership of everything you put into Faunary: your notes, stories, encounter and observation records, species and location selections, and the metadata in your archive. We do not claim ownership of your content.

Faunary is a memory layer over an archive you keep, not a photo backup. When you add a photo, your browser reads its metadata and creates a small compressed cover image. Only that cover and the metadata are sent to us. Your original photo file stays on your device. We never receive or store your originals.

To run the service, you grant us a limited, non-exclusive licence to store, process, display, analyze, and transmit the content you provide, solely to operate and improve Faunary. This licence ends when you delete the content or your account, except for backups that age out on our normal schedule.

4. What Faunary does with your archive

To provide its features, Faunary processes the content you add. This includes metadata extraction, species suggestions, timeline and era generation, archive reconstruction, narrative summaries, Field Intelligence discoveries, and search. These features exist to help you understand and explore your own archive.

5. AI-assisted features

Some features use third-party AI providers to generate summaries, suggestions, narratives, or insights. AI output can be wrong, incomplete, or misleading, and it is assistive only: it does not make decisions for you, and you stay responsible for reviewing anything that matters. See our Privacy Policy for what is sent to these providers.

6. Responsible use

You agree not to:

  • break applicable laws,
  • upload content you do not have the right to use,
  • disrupt, abuse, or probe the service or its infrastructure,
  • interfere with other users,
  • use Faunary to distribute malware, spam, or harmful content.

7. Beta status, and your own backups

Faunary is an evolving service. Features may change, move, or be removed over time. We take reasonable measures to protect your data, but you should keep your own backups of important photographs and records. Faunary is not a backup service, and because we never hold your originals (see section 3), it cannot stand in for one.

8. Your archive is portable

We believe your archive belongs to you. Faunary aims to provide reasonable means to export your archive data, including your cover images and structured records, in a portable format. Export functionality may evolve as the platform develops.

9. Availability

We work to keep Faunary available and reliable, but we cannot promise uninterrupted service. Maintenance, outages, infrastructure failures, or third-party interruptions may affect availability.

10. Ending your use

You can stop using Faunary at any time and delete your account. We may suspend or end access if you break these Terms or to protect the security and integrity of the service.

11. Disclaimer and liability

Faunary is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties about availability, accuracy, fitness for a particular purpose, and uninterrupted operation, and we are not liable for indirect, incidental, consequential, or special damages arising from your use of the service.

Nothing in these Terms excludes or limits our liability for intent, gross negligence, death or personal injury, fraud, or any liability that cannot be excluded or limited under applicable law.

Nothing in these Terms limits or excludes any rights you have as a consumer that cannot be limited or excluded under the law that applies to you.

12. Governing law

These Terms are governed by the laws of Germany, without affecting any mandatory consumer-protection rules of the country where you live. Where the law allows, disputes will be handled by the courts responsible for our place of business.

13. Changes

We may update these Terms from time to time. When changes are material, we will let you know through the service where practical. Continuing to use Faunary after changes take effect means you accept the updated Terms.
